Terms and Conditions

Last updated: September 4, 2026

These Terms and Conditions govern your access to and use of Hat Rack websites, mobile-connected experiences, accounts, stories, tours, shop, cart, checkout, wishlists, bucket lists, footprint tools, public profiles, promotion tools, agency workflows, payment features, vouchers, support channels, and related services.

Platform Scope Accounts Uploaded Content Orders and Payments Refund Policy Agency Tools Privacy Liability Contact
Privacy Policy Back to Hat Rack
These Terms are drafted as a practical global baseline for a travel, ecommerce, content, and agency platform. Mandatory consumer, privacy, payment, tax, travel, or ecommerce laws that apply in a user’s country will override any conflicting part of these Terms where the law does not allow that right to be limited.

1. Who We Are and What These Terms Cover

Hat Rack operates a digital platform for travel discovery, stories, footprint memories, bucket-list planning, ecommerce products, tour and promotion features, customer accounts, agency commerce, payments, vouchers, support, and related services. References to “Hat Rack,” “we,” “us,” or “our” mean Hat Rack and its relevant operating team, unless a specific local legal entity is identified at checkout, in an invoice, or in a separate contract.

2. Acceptance, Changes, and Additional Rules

By browsing the platform, creating an account, uploading content, saving items, placing an order, booking or redeeming a voucher, applying as an author or agency, making a payment, or using any service, you agree to these Terms and the Privacy Policy. If you do not agree, you must not use the platform.

Some listings, products, tours, promotions, checkout zones, vouchers, memberships, or agency tools may include additional conditions. Those additional conditions form part of these Terms for that transaction or feature. If there is a conflict, listing-specific, checkout-specific, or written contract terms apply to that transaction unless mandatory law says otherwise.

3. Eligibility, Accounts, and Security

You must be legally capable of using the platform and, where required, old enough to consent to digital services in your country. Users under 18 may use the platform only with parent or guardian involvement, especially for payments, bookings, travel arrangements, public posts, or uploads.

You are responsible for accurate account details, your password, OTP access, device security, shipping details, market preferences, public-profile choices, and all activity under your account. You must promptly tell us about suspected unauthorized use. We may suspend, restrict, or close accounts where we reasonably believe there is fraud, abuse, impersonation, unlawful use, payment risk, security risk, or breach of these Terms.

4. Permitted Use and Prohibited Conduct

You may use the platform for lawful personal, customer, author, agency, or approved business purposes. You must not misuse the service, attack or probe security, scrape data at scale, upload malware, submit false payment or identity information, interfere with other users, abuse coupons or promotions, bypass paid limits, misrepresent travel or business credentials, infringe intellectual-property rights, or publish unlawful, harmful, defamatory, discriminatory, sexual, exploitative, violent, misleading, or privacy-invasive material.

We may moderate, remove, restrict, reject, or preserve content and account records where needed for security, legal compliance, fraud review, payment disputes, user safety, or enforcement of these Terms.

5. User Images, Artwork, Documents, and Other Content

You may upload or submit profile photos, footprint photos, city memories, bucket-list images, comments, reviews, stories, blog images, product customization artwork, print files, promotion images, passport or license documents for approved workflows, tour listing media, agency details, and other content. You confirm that you own or have the necessary rights and permissions to upload, display, print, process, store, and share that content for the intended feature.

You keep ownership of your lawful user content. You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, resize, crop, format, display, transmit, moderate, translate, use in previews, generate thumbnails, include in order or voucher records, print or fulfil customized products, and otherwise process your content to operate, improve, protect, and promote the platform and its related services. This license ends when your content is deleted except where copies are needed for completed orders, legal records, backups, disputes, fraud prevention, or content already shared by others.

If you upload artwork for a customized product, you are responsible for image quality, placement, spelling, color expectations, ownership rights, and suitability for printing. We may reject or cancel custom work that appears unlawful, infringing, unsafe, technically unusable, or inconsistent with our production standards.

6. Public Profiles, Footprint Feed, Stories, and Community Features

Some features allow content to be public, private, or limited by your settings. Public content may include your name, profile photo, author profile, public footprint entries, travel dates or ranges, city or country, notes, YouTube previews, comments, likes, follows, reviews, story content, bucket-list shares, or related metadata. Public content may be viewed, saved, indexed within the platform, shown in feeds, or linked from public pages.

You are responsible for deciding what to publish. Do not post addresses, identity documents, bank details, private travel plans, children’s information, medical data, passwords, or other sensitive information in public fields.

7. Products, Tours, Orders, Vouchers, and Payments

Prices, taxes, currencies, availability, delivery options, tour slots, promotion rates, shipping methods, payment methods, inventory, voucher validity, and listing details may vary by market and can change before order confirmation. An order, booking, subscription, promotion, or voucher is confirmed only after successful checkout, payment verification, internal risk checks, and any required agency or operator acceptance.

The platform may support payment methods such as Stripe, Razorpay, cards, UPI, netbanking, hosted checkout, internal test payments in local development, or other configured gateways. Payment providers may process card, bank, UPI, wallet, device, fraud-screening, and transaction data under their own terms. We generally store payment references, gateway IDs, order metadata, billing/shipping details, voucher state, refund state, and reconciliation records, not full card numbers or CVV codes.

We may refuse, cancel, hold, or review transactions affected by suspected fraud, pricing or tax errors, inventory mismatch, unsupported market, failed verification, chargeback risk, provider cancellation, duplicate order, abusive use, or legal restriction.

8. Refund, Cancellation, and No-Trial Policy

Unless mandatory law, a listing-specific promise, or a written approval from us requires a different outcome, all payments are final once an order, booking, voucher, promotion, membership, or custom-product request is confirmed. The platform is not offered on a free trial, try-before-pay, use-first, or approval-after-use basis unless we expressly provide that option in writing or on the relevant checkout page.

Refunds may be considered only in limited cases

  • We or an approved provider cancel a paid service and cannot offer a reasonable replacement.
  • A duplicate charge, gateway processing error, or verified technical payment failure occurred.
  • A paid product or service was not delivered because of a fault within our company-controlled process.
  • A physical product is materially defective or materially different from the confirmed order due to our error, subject to inspection and return requirements.
  • A refund is required by mandatory consumer, ecommerce, travel, or payment law that applies to the transaction.

Refunds normally will not be provided for

  • Change of mind, accidental purchase, personal scheduling conflict, failure to attend, late arrival, incomplete travel documents, or visa/passport issues.
  • Used, redeemed, expired, transferred, downloaded, accessed, customized, printed, or partially consumed services, products, vouchers, promotions, or membership benefits.
  • User-supplied artwork, photos, spelling, placement, size, quality, copyright, or design choices after production or fulfilment has started.
  • Suspension or termination caused by breach of these Terms, fraud, abuse, chargeback misuse, or unlawful conduct.
  • Dissatisfaction with user-generated content, public feed visibility choices, or third-party content where the platform itself performed as described.

Approved refunds may be returned only to the original payment method where required or supported by the payment provider. Processing timelines depend on the gateway, bank, card network, currency, and country. Refund requests should include the order number, payment reference, reason, screenshots or evidence, and the email or mobile number used at checkout.

9. Authors, Agencies, Promotions, Wallets, and Settlements

Author, agency, promotion, wallet, voucher validation, withdrawal, settlement, and finance tools are conditional features. We may request identity, business, license, tax, payout, market, bank, content, or operational details to review eligibility, prevent abuse, comply with law, process settlements, and manage customer disputes.

Agency payouts may be subject to hold periods, finance review, refund or chargeback reserves, market restrictions, minimum withdrawal thresholds, bank verification, tax records, and manual approval. We may pause or reverse settlement activity if a related order, voucher, tour, promotion, or account is under dispute or investigation.

10. Memberships, Premium Features, Promotions, and Ads

Premium features, membership limits, reduced-ad experiences, footprint limits, promotional placements, coupons, and sponsored listings may vary by market and may be changed, paused, removed, or repriced. Promotions and ads must comply with platform rules, intellectual-property requirements, payment terms, and applicable advertising laws. We may reject, remove, pause, or require changes to promotions that are misleading, unlawful, unsafe, or unsuitable for the platform.

11. Privacy, Data Protection, and Security

Our Privacy Policy explains what personal data we collect, how we use it, how user uploads are handled, how payment data flows through gateways, how public content works, how data requests can be made, and how long records may be retained. By using the platform, you acknowledge that data may be processed across countries by us and by providers needed to operate the service.

We use reasonable administrative, technical, and organizational safeguards, including password hashing, role and permission controls, CSRF protection for web forms, server-side validation, gateway signature verification, selected secret encryption where configured, and vendor controls. No online system is completely secure, and users must keep passwords, OTPs, devices, and payment credentials confidential.

12. Third-Party Services

The platform may integrate payment gateways, shipping or fulfilment services, tour operators, agencies, hosting providers, email providers, social-login providers, maps, embedded media, analytics, advertising, document generation, or other third-party services. We are not responsible for independent third-party services, websites, policies, outages, pricing, content, security, or decisions, except where mandatory law makes us responsible.

13. Platform Intellectual Property

The platform, code, design, layout, databases, features, workflows, brand marks, templates, generated assets, written content, graphics, and original media are owned by us or licensed to us. You may not copy, scrape, reverse engineer, republish, resell, frame, commercially exploit, or create competing datasets from the platform except as permitted by law or with our written consent.

14. Disclaimers and Limitation of Liability

The platform is provided on an “as available” and “as updated” basis. We do not guarantee uninterrupted service, error-free operation, perfect content accuracy, specific travel results, exact color matching for screens and prints, guaranteed agency earnings, guaranteed promotion performance, or availability of all features in every market.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, punitive, reputational, loss-of-profit, loss-of-data, travel disruption, missed opportunity, payment-provider, bank, operator, agency, user-content, or third-party service damages. Nothing in these Terms excludes liability that cannot legally be excluded.

15. Suspension, Termination, and Record Retention

We may suspend, restrict, remove content, cancel transactions, withhold payouts, or terminate access where necessary for compliance, fraud prevention, security, user safety, payment review, moderation, unpaid amounts, chargeback risk, or breach of these Terms. Account closure does not automatically erase records that must be retained for tax, accounting, legal, fraud-prevention, refund, chargeback, dispute, settlement, or completed-order purposes.

16. Governing Law, Disputes, and Global Users

These Terms are drafted for a platform operating internationally with primary operational focus in the United Arab Emirates and India. Where legally permitted, disputes should first be raised with us through the relevant contact below so we can try to resolve them in good faith. The governing law, forum, and mandatory rights may depend on the contracting entity, the user’s country, the product or service type, the checkout market, and non-waivable consumer protection laws.

17. Updates to These Terms

We may update these Terms to reflect product, legal, operational, payment, security, or business changes. The latest version will be posted on this page with the updated date. Continued use of the platform after updated Terms become effective means you accept the revised version.
